These terms and conditions were last updated on 14 August 2009 and replace all previous terms and conditions for CHCC website.

Please read these terms and conditions carefully.

Irrespective of the delivery platform you use or of how the CHCC Content (defined below) is delivered to or accessed by you, by accessing and/or subscribing to and/or using the CHCC website and the online content/services available on it ("CHCC Content") you are agreeing to be bound by these terms and conditions. If you use the CHCC website in the course of your business, you are also agreeing to these terms and conditions on behalf of that business and should also read the section regarding At Work Use.

If you do not agree with the terms and conditions (or are not authorized to do so) you should not use the CHCC website and should log out now. If you have any questions please email us at children@chc.org.sg.

CHCC website - Privacy Statement

CHCC may change, alter or withdraw any part of CHCC website at any time (with or without notice to you) and may also change the terms and conditions. If you do not agree to the changes you should cease to use CHCC website.

References in these terms and conditions to "CHCC" (or "we", "us" or "our") refer to the organization operating the CHCC website, see the Corporate Information section below for more details.

From time to time CHCC may run or permit to be run competitions, promotions, advertisements and surveys on CHCC website. These are subject to additional terms and conditions that will be made available at the time they are run.

  1. Access and Use


    2. CHCC reserves the right to change the manner in which CHCC Content is made available or accessible to users.

    Permitted Use: All CHCC Content belongs to CHCC or its licensors. CHCC or its licensors own all intellectual property rights (including copyright and database rights) in the CHCC Content and any selection or arrangement of the CHCC Content. You may for your personal and non-commercial use:

    • retrieve and display CHCC Content on any compatible device;
    • print a single copy of individual articles on paper (but not photocopy them); and
    • store such articles in electronic form on disk or on a mobile device (but not on any server or other storage device connected to a network).

    You may also on an occasional and infrequent basis email headlines appearing on the CHCC website (but not full text articles) to a maximum of five individuals using our 'Email Article' service, provided that you shall not use this function for the purpose of either creating a commercial or revenue-generating service or regular information dissemination within any organization or other entity: if you would like to use the CHCC website headlines in this way please refer to the “At Work Use” paragraph below.

    Restrictions on Use: You may not use the CHCC website for any unlawful purpose. Except as expressly set out above, you may not copy, reproduce, publish, broadcast, transmit, modify, adapt, create derivative works of, store, archive, publicly display or in any way commercially exploit any of the CHCC Content. Without limitation, you may not do any of the following without prior written permission from CHCC (and neither may you allow a third party to do any of the same):

    • redistribute any of the CHCC Content, including our headlines (including by using it as part of any syndication, news or content aggregation, library, archive or similar service); or
    • deep link to, frame, spider, harvest or scrape the CHCC Content or otherwise access the CHCC Content for similar purposes; or
    • create a database in electronic or structured manual form by systematically and/or regularly downloading/printing and storing all or any of the CHCC Content; or
    • remove the copyright or trade mark notice from any copies of CHCC Content made under these terms and conditions; or
    • use any machine, electronic, web based or similar device to read or extract the CHCC Content by automated or machine based means.

    You acknowledge that "CHCC" is a proprietary trade mark ("trade mark" includes service marks) and that you may not use it without prior written permission from CHCC.

    Linking: If you would like to link to the CHCC website, please read and comply with the following guidelines and all applicable laws. A site or service that links to the CHCC website:

    • must not use the CHCC trade mark without permission from CHCC;
    • may link only to the homepage of CHCC website unless CHCC has otherwise given prior written permission;
    • may not remove, distort or otherwise alter the size or appearance of the logo;
    • must not be a site or service that contains content that could be construed as distasteful or offensive or that could be prohibited by all relevant laws and legislation;
    • must not in any way imply that CHCC is endorsing it and/or its products or services;
    • must not misrepresent its relationship with CHCC or present false information about CHCC;
    • must not be a site or service that infringes any intellectual property or other right of any person or that otherwise does not comply with all relevant laws and regulations.

    CHCC expressly reserves the right to require that any link in breach of these terms and conditions be removed and to take whatever action it deems appropriate.

    At Work Use: If you are using CHCC website in an "at work" capacity (whether for a company, partnership, public sector body, club, association, charity, etc.) and your use extends beyond personal, non-commercial use then you should contact CHCC at children@chc.org.sg to discuss your business requirements, since it is possible that your use of CHCC Content extends beyond what is permitted by these terms and conditions. In particular, all requests to republish, redistribute or syndicate CHCC Content, whether headlines, full text articles (or parts thereof) or the right to use CHCC Content internally within your business (for example, as part of a regular information dissemination service or on a company Intranet) or any external use that you may make (for example, within client reports or briefings) should be addressed to us, as such use falls outside the scope of use permitted by these terms and conditions.   2. Privacy Statement and Registration


    3. All information received by CHCC from your use of CHCC website may be used by CHCC and such use shall be in accordance with our Privacy Statement.

    If registration is required, you must provide CHCC with accurate, complete registration information and it is your responsibility to update and maintain changes to that information on the applicable CHCC website registration pages. CHCC is entitled to rely on any information you provide to us.

    If you provide CHCC with an email address that will result in any messages CHCC may send you being sent to you via a network or device operated or owned by a third party (e.g. your employer or college) then you warrant that you are entitled to receive those messages. You also agree that CHCC may refrain from sending messages to you without notifying you, even if you have subscribed to receive them, if we receive a request from a third party to stop sending messages to you.

  3. Technical Requirements and Site Security


    4. The CHCC website is best viewed using the Internet browsers IE7 or Mozilla Firefox 3 at 1024x768 resolution. Any older browser versions may work but users could have limited browsing capability.

  4. Exclusion of Liability


    5. The CHCC Content is only for your general information and use and is not intended to address your particular requirements. In particular, the CHCC Content does not constitute any form of advice, invitation, recommendation, representation, promotion or endorsement by CHCC related to any product listed or referred to or otherwise and is not intended to be relied upon by users in making (or refraining from making) any specific investment or other decisions. Appropriate independent advice should be obtained before making any such decision. Any agreements, transactions or other arrangements made between you and any third party named on (or linked to from) CHCC website are at your sole risk and responsibility.

    Any information that you receive via CHCC website whether or not it is classified as "real time", may have ceased to be current by the time it reaches you and share price or currency information may be rounded up/down and therefore not entirely accurate. CHCC is not responsible for any use of the CHCC Content by you outside its scope as stated in these terms and conditions.

    No Warranty: This website and the Materials are provided on an “as is" and "as available" basis. CHCC does not warrant the accuracy, adequacy or completeness of this website and/or the Materials and does not endorse or promote all or any part thereof and expressly disclaims liability for errors or omissions in the Materials. CHCC does not give any warranty in respect of CHCC website. To the extent permitted under applicable law, CHCC hereby disclaims all warranties, conditions or duties of every nature whatsoever, including without limitation, warranties of non-infringement of third party rights and/or title, any implied warranties of satisfactory quality, merchantability or of fitness for a particular purpose, any express or statutory warranties, and any warranties or duties regarding accuracy, timeliness, completeness, performance, availability or lack of negligence. CHCC does not warrant that this website and/or any of the Materials will be provided uninterrupted or free from errors or that any identified defect will be corrected; further, no warranty is given that this website and the Materials are free from any virus or other malicious, destructive or corrupting code, program or macro or anything else that has contaminating or destructive properties.

    To the fullest extent permitted under applicable law, CHCC shall not be liable to you for any loss or damage, special or consequential, and including lost profits or loss of privacy or loss of or damage to data, arising whether or not as a direct or indirect consequence of:

    1. any access, use or the inability to access or use this website, or reliance on the Materials and/or any information in this website;
    2. any system, server or connection failure, error, omission, interruption, delay in transmission, or computer virus; and
    3. any use of or access to any other website linked to this website,

    even if CHCC or its agents or employees are advised of the possibility of such damages, losses and/or expenses. Any hyperlinks to any other websites are not an endorsement or verification of such websites and such websites should only be accessed at the user's own risks. This exclusion clause shall take effect to the fullest extent permitted by law.

    In addition to but separate from the above specific exclusion and to the fullest extent permitted under applicable law, CHCC shall also not be liable to you for any other indirect, special, consequential, incidental, punitive or exemplary damages whatsoever that arise out of or are related to your use of CHCC website.

    The above disclaimers and exclusion of liability apply equally to your use of CHCC website and all CHCC Content.

However, you may download and print the Materials on this website for personal, non-commercial use only provided you do not modify the Materials and that you retain all copyright and other proprietary notices contained in the Materials. You also may not, without the permission of CHCC, insert a hyperlink to this website on any other website or "mirror" any Material contained on this website on any other server.

    In the event that we offer downloads of software and you download such software, the software, including any files, images incorporated in or generated by the software, and data accompanying the software (collectively, the "Software") are licensed to you by us or third-party licensors for your personal, noncommercial home use only. We do not transfer title to the Software to you.     Trade Mark: The trade mark, service mark and logo (the "Trade Mark") used and displayed on this website are registered and unregistered Trade Mark of CHCC or its licensors. CHCC aggressively enforces its intellectual property rights to the fullest extent of the law. The name of CHCC or the Trade Mark may not be used in any way, including in advertising or publicity pertaining to the distribution of Materials on this website, without prior written permission of CHCC. CHCC prohibits use of the Trade Mark as a "hot" link or inlink to any site unless establishment of such a link is approved in advance by CHCC in writing.

  6. Non-Confidentiality

You agree that all information and/or particulars sent or submitted by you to CHCC in relation to the access of this website is non-confidential and non-proprietary unless otherwise expressly indicated by you. You further undertake not to submit any information and/or other materials which are or may be offensive, illegal or which may not be lawfully disseminated under the laws of Singapore or any other relevant country.

  7. Third Party Sites and Services


    8. CHCC website contains links to other Internet websites or online and mobile services provided by independent third parties ("Third Party Sites"), either directly or through frames. Third Party Sites may be co-branded with CHCC and so include CHCC's trade mark. CHCC is not responsible for the availability or content of Third Party Sites and will not be a party to, or in any way responsible for, any transaction concerning goods or services available from such Third Party Sites. If you purchase products or services from a Third Party Site your contract for such products or services will be with the third party and not with CHCC. Our Privacy Statement does not apply to Third Party Sites.

    Copyright in any software that is made available for download from CHCC website belongs to CHCC or its suppliers. Your use of the software is governed by the terms of any licence agreement that may accompany or be included with the software. CHCC is not responsible for any technical or other issues that may arise if you download third party software. Do not install or use any software unless you agree to such licence agreement.

    The CHCC website may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on CHCC website complies with all applicable laws. CHCC will not be responsible for any error or inaccuracy in advertising, promotional or sponsorship material.

  8. Exclusion of Third Parties Rights


    9. No person shall have any right pursuant to the Contracts (Right of Third Parties) Act (Cap. 53B) to enforce any of the above terms and conditions.

    The reference to a person, in this clause includes any individual, company, corporation, firm, partnership, joint venture, association, organization, trust, state or agency of a state (in each case, whether or not having separate legal personality).

  9. Governing Law and Jurisdiction

By accessing this website, you agree that Singapore law, including without limitation the provisions of the Singapore Evidence Act (Cap. 97) and the Electronic Transactions Act (Cap. 88), shall govern such access as well as these terms and conditions and you agree to irrevocably submit to the exclusive jurisdiction of the Singapore courts to settle any dispute which may arise out of, under, or in connection with these terms and conditions.

    11. You may not assign, sub-license or otherwise transfer any of your rights or obligations under these terms and conditions.

    If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.

    Failure by either party to exercise any right or remedy under these terms and conditions does not constitute a waiver of that right or remedy. Headings in these terms and conditions are for convenience only and will have no legal meaning or effect.
